Leasehold Reform Act 1993 — Section 42

Generate Your Section 42 Notice

A properly drafted statutory notice to serve on your freeholder, initiating your right to a lease extension of 90 years added to the unexpired term, at a peppercorn (zero) ground rent.

Important: This tool generates a draft notice for review purposes. You must have this notice reviewed by a specialist leasehold solicitor before serving it. If you withdraw a valid notice, or it is treated as withdrawn (for example, if you miss a deadline or do not complete), you cannot serve a new Section 42 notice on that flat for 12 months. A notice that is invalid from the start does not trigger this, but it will not protect your claim either, so check it carefully. Longhold accepts no liability for notices served without professional legal review. Terms of Use
Property Details

The full address of the leasehold flat for which you are claiming a new lease.

The address of the freehold title to which the notice extends. Usually the whole building address.
Found on your official title register from Land Registry (currently £7 to obtain). Get your title register here. A title plan is needed to identify the correct property. It is not mandatory for a Section 42 notice, but we strongly advise including one.
Lease Particulars

These must exactly match your original lease document. Even minor errors can invalidate the notice.

Where to find this information: Your original lease deed (held by your solicitor or yourself), or your official Land Registry title register. The exact wording of the parties' names must match the lease precisely.

Current Parties

The current freeholder, any intermediate landlords, managing agents, and your own details as the claimant.

Competent Landlord (Freeholder)
If a company, obtain exact registered name from Companies House. Must be correct.
This is where the notice will be served. Must be a valid address for service.
Managing Agent (if applicable)
Leaseholder (You / Claimant)
If joint owners, include all names exactly as they appear on the title register
Your Solicitor / Agent (Recommended)
The freeholder's solicitors will send their Section 45 counter-notice to this address. Strongly recommended to use a solicitor.
Proposed Terms

The premium you propose to pay and the terms of the new lease. These will be the opening offer — the freeholder may counter-propose.

On the premium: This should be based on a professional valuation. An unrealistically low offer may be challenged (see Cadogan v Morris) and could result in the notice being treated as not genuine. Use your Longhold estimate as a starting point — your solicitor and surveyor will advise on the final figure to insert. We can put you in touch with a specialist surveyor who can provide a professional valuation.
Your opening offer. Must be a genuine figure based on valuation advice.
This figure is an estimate only. Replace it with the correct amount as soon as you know it. It goes into your notice as the amount you propose towards the freeholder's legal costs. You will be liable for their reasonable costs, which are typically £1,000 to £2,000 plus VAT.
90 years added to your unexpired term (current law). The 2024 Act proposes 990 years but is not yet in force.
Peppercorn — zero ground rent. Statutory requirement.
The date the notice is served. This triggers the statutory timetable.
Calculated automatically — minimum 2 months + 3 days from notice date for deemed receipt
